Terms and conditions
Your purchase and use of the products and services available via Luxe Appearance Limited is subject to the following terms and conditions. By using this website, luxeappearance.co.nz you confirm that you have read, understood and accepted these terms and conditions of sale, and agree to be bound to them.
Please advise staff if you are unwell, have any allergies or are taking any medication.
TREATMENT CANCELLATION POLICY
There is a 48 hour cancellation policy which is non refundable, this is half the payment for the service that you have booked for. If you have booked and no show your appointment then you will be charge 100% of your appointment fee.
Our shopping cart is secure and protected. When entering payment details, you will be redirected to the Stripe secure hosted payment page to submit your credit card details. All supplied sensitive/credit information is transmitted via PCI certified payment service that is facilitated by Stripe, and only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.
All prices shown are in New Zealand Dollars and inclusive of GST (Goods and Services Tax) of 15% but exclusive of delivery charges.
We reserve the right to alter prices on the site without notice. Where your order is accepted, the price of a product displayed on the website at the time the order is received will be accepted and honoured as correct.
We accept Visa and Mastercard. Goods will only be dispatched once full payment has been received and funds have been cleared.
An automatic email confirmation of the order will be sent to the customer’s registered email address. Luxe Appearance Limited reserves the right to review and/or cancel orders containing information that cannot be verified.
CANCELLATION OF ORDERS
In order to provide our customers with the quickest possible delivery, most orders will be shipped within 48 hours after order details have been verified and payment has been received. If customers would like to cancel an order, you are requested to contact Luxe Appearance Limited within 24 hours of placing your online order. Requests for cancellation will be considered on a case-by-case basis and we (Luxe Appearance Limited) will exercise its sole discretion in determining whether an order placed through the site may be cancelled.
RETURNS AND EXCHANGES
Luxe Appearance Limited recommends that customers thoroughly inspect goods upon receipt, and before removing any attached tags or disposing of any original packaging.
We hope that you will be happy with your purchase from Luxe Appearance Limited.
We will not accept goods in damaged packaging unless they are faulty.
Delivery charges and return freight costs will not be refunded unless the goods are faulty.
We will only accept goods returned with prior notification through correspondence via email to email@example.com Please advise the reason for the return including instructions on whether you prefer the goods to be refunded, exchanged or a gift voucher provided.
There is no return or exchange for sale items.
We will not accept any returned goods that have been used, altered, damaged, or have their labels removed.
All returned goods must be sent to Luxe Appearance Limited – 228 Orakei Road, Orakei Auckland.
We cannot guarantee that we will be willing to accept the item for return or exchange if you do not contact us via email within ten days of receiving your goods.
RECEIVING A REFUND
Once your goods have been returned to us within the above stated time frame and passed quality checks, we will process your refund request. Your refund will be processed in the original payment format as your purchase was made within 30 days of the initial return request received via email. All returned products will be credited to the original purchasers including GST but excluding courier charges. You will be notified via email to the address listed on your account when the transaction has taken place.
Please note: if we receive your return in a condition which we feel is not fit for exchange or refund we shall get in touch with you to discuss next steps. Luxe Appearance Limited reserves the right to refuse an exchange or return for any item sent back in a used or damaged condition.
AVAILABILITY OF PRODUCTS
Luxe Appearance Limited will always endeavour to have full stock of our items, however we may encounter small delays in supply. Also from time to time, heavy demand, limited editions or other factors beyond the control of Luxe Appearance Limited may render the products temporarily or permanently unavailable. In such circumstances the customer will be advised of the delay, the length of the delay and given product alternatives or the option of placing the product on backorder.
Where product specifications are shown, and are as accurate as we can make them. However at time the specifications of the product you purchase may vary from that shown.
LIMITATION OF LIABILITY
Our liability for any claim, damages, loss, or expense related to the supply by us of goods or services is limited to the cost paid by you for the goods or services and except where statute expressly requires otherwise. To the fullest extent permitted by law Luxe Appearance Limited will not be liable in any event whether in contract or in tort (including negligence), or otherwise for any loss of profits or any consequential, indirect or special damage, loss or injury of any kind suffered by you or any other person, even if we were informed of the possibility of such damages.
Luxe Appearance Limited shall not incur liability in respect of anything which might otherwise constitute a breach of its obligations under these terms and conditions arising by reason of “force majeure” (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of any government or government agency, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of Products or raw materials, delay in transit, electricity or communications failures, or other causes whatsoever beyond the reasonable control of Luxe Appearance Limited. Luxe Appearance Limited shall be excused from such performance to the extent of such prevention.
LAW AND JURISDICTION
This website and any contract for your purchase from Luxe Appearance Limited is governed by and has to be interpreted under the Law of New Zealand, and will be subject to the jurisdiction of the New Zealand courts. The Laws of Sale and contract by any other country do not apply.
CONSUMER GUARANTEES ACT 1993 (“THE ACT”)
If you are a consumer under the Act and you are acquiring or holding yourself out as acquiring the goods for a business purpose, the Act will not apply. Subject to this clause nothing in these terms will affect your rights as a consumer under the Act.
Consumer Guarantees Act 1993
1. The provisions of the Consumer Guarantees Act 1993 (“CGA”) shall not apply to any supply of Product to you, and the conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statue or common law will not apply and are excluded from these terms of trade.
2. Where you purchase any Products from us for resupply as, or incorporation into, goods or services ordinarily acquired for personal household or domestic use or consumption (“Consumer Products”) you warrant that:
1. If you supply the Consumer Products directly to an end user/consumer you will do so using terms and conditions of supply which exclude liability for any claims under the CGA; and
2. if your customer acquires any Products for resupply, you will ensure that your customer and each person in the distribution chain will exclude liability in its contract for supply for any claims under the CGA
